How Workers’ Compensation Laws Work

Workers’ compensation law differs from other types of personal injury claims. Workers’ compensation laws were developed as a response to the needs of injured miners who had no recourse for financial recovery after a work accident. Some states have a unique set of workers’ compensation laws, each of which provide a path for work injury victims to recover medical costs and lost wages, excluding the option of filing personal injury lawsuits against their employers. There are exceptions to this general rule of “claim exclusivity” however.

Workers’ Compensation laws are generally designed to ensure that employees who are injured or disabled on the job are provided with fair monetary compensation. But sometimes companies and private employers disregard these laws and fail to pay sufficient money to those injured or disabled on the job. From sending employees to “employer-biased doctors” to threatening injured employees with termination, unfair treatment of injured employees is commonplace in workers’ compensation claims. This is the primary reason why it is critical to contact an experienced worker’s compensation lawyer from the start.

Temporary Total Disability (TTD)

The first work comp term we’ll look into is temporary total disability (TTD). If you have been injured on the job, and missed work as a result of the injury, you can seek TTD benefits. A doctor must certify that you are unable to return to work because you are recovering from the injury.

Temporary Partial Disability

Temporary partial disability comes into play if you are injured on the job, and the doctor limits your physical activity. If the injury prevents you from performing certain job requirements, but you can still work at a reduced job level, temporary partial disability will cover the pay difference.

Permanent Disability in Excess of Physical Impairment

Permanent disability in excess of physical impairment (PPD > PPI) is not something that the insurance companies will often tell you about. In certain situations, victims of work-related injuries may be entitled to disability payments above the physical impairment. This would be talked about once the employee approaches the maximum medical improvement.

Total and Permanent Disability (TPD)

If an injury is so severe that a worker is completely disabled for the remainder of his or her life, the employee would be eligible for permanent and total disability benefits.

Auto Accidents

Traffic accidents can be devastating, but insurance companies will try to downplay your injury and property damage claims. The car accident attorneys at our firm are dedicated to helping clients receive the maximum compensation for their injuries. Our lawyers are experienced in representing victims of texting and driving, pedestrian accidents, car wrecks, bus crashes, head on collisions, DUI accidents, motorcycle crashes, railroad accidents, bicycle wrecks, and trucking accidents.

Dog Bite

Dog bites and animal attacks account for more than a third of all homeowners’ insurance liability claims. It is primarily the dog owner’s responsibility to take precautions when their dog is around humans—especially children. Sadly, more than half of all dog bites affect children, and the sheer strength of a dog’s jaw can leave devastating results. If you or your child has been bitten by a dog, see a doctor, and report the incident to animal control. They will investigate the dog to ensure that the animal has had all of the necessary vaccines and determine whether or not an anti-rabies treatment is necessary. Additionally, call a  dog bite lawyer at our firm so that we can deal with the insurance adjuster.

Workers Compensation

It’s important to understand that workers’ compensation laws can vary greatly from state to state. Some have a unique set of laws regarding employees who have been injured on the job. While these laws were created to ensure that employees receive fair compensation for their injuries or disabilities, employers have been known to disregard these laws and fail to pay their injured employees what they’re entitled to. Our workers’ compensation lawyers are available to help you with your work comp claims from the beginning. If you’ve been injured in a construction accident or slip & fall injury on the job, call a  workers compensation attorney at our firm for a free consultation.

Product Liability

When you purchase a product, you should be able to assume that you won’t be injured by using it. If you have suffered physical harm because of a defective product, it is imperative that you document everything that relates to the situation. If you’ve been injured by a product, contact us to see if we can assist you in your claim.

Drug Recalls and Medical Malpractice

While many hospitals, nursing homes, and family doctors provide excellent care to their patients, doctors, nurses, and hospital staff have been known to make medical mistakes. Sometimes these mistakes can cause birth defects, serious injury, and even death. If you or a loved one has been injured as a result of medical malpractice, nursing home neglect, or a dangerous drug, contact us today.

None of the Above?

If your claim does not fall squarely into one of these categories, contact our office. In addition to the practice areas listed above, we have experience with traumatic brain injury victims, jones act claims, dram shop claims, and insurance bad faith claims. Calling a lawyer at our firm will at least give you a starting point for your case, and we’re happy to point you in the right direction for free. We’ll let you know if you are better off representing yourself, or, if we think you might be better represented by a different law firm, we can see if we have a partner firm with expertise in your case type.
