We receive phone calls each day from innocent victims of injury throughout Arkansas. The most common questions we receive on each call include:

How much money is a fair settlement for an Arkansas car accident claim?

How can I negotiate a settlement with an insurance claims adjuster?

How long does it take to get a settlement for an injury claim?

Are personal injury settlements taxable?

Who are the best injury attorneys in Arkansas?

What are your attorneys' fees?

Should I sign an authorization to permit the insurance company to collect my medical records?

Some of these questions are difficult to answer. In fact, it is misleading for lawyers to give you grand opinions of what your case will settle for and how long the process will take. The Arkansas Injury Law Center will be able to provide you with an idea of what your case is worth, but there are no guarantees in the practice of law. We would rather underpromise and overdeliver than set a potential client up for dissappoinment.

We are recognized as having some of the best injury lawyers in Arkansas. That has been accomplished through hard work, dedication to protecting the rights of people hurt in accidents, and providing a level of personal attention that is not matched by other local law firms. In providing aggressive legal representation, we are able to obtain settlements in a shorter timeframe than other "high volume" law firms. We never charge attorneys' fees unless we win your case. And even then, it is a percentage of your settlement, not some arbitrary number.

Negotiating with an insurance claims adjuster is difficult. Primarily because you are not in an equal position of bargaining power. They hold all of the cards, and most importantly, the money. And without the threat of a lawsuit by your lawyer, the big insurance companies have little incentive to offer you a fair settlement. Once a
Arkansas injury attorney steps in however, the scales of justice tilt in your favor.

If you have questions about the insurance claims process, ask for advice from an experienced injury attorney in Arkansas. Calling (855) 365-HURT is a good start to getting your legal claim protected. Consultations are always free of charge. Even if you do not require an attorney, the consultation will arm you with the information necessary to file a claim without a lawyer and obtain a settlement.

How to Negotiate a Fort Smith Arkansas Car Accident Injury Claim

Folks injured in car accidents don't know where to turn for competent legal advice. The
insurance claims process is unfamiliar to most everyday citizens. Injury insurance claims for compensation are notoriously complex and vague. The process is designed that way by large insurance companies. Lawyers draft car insurance policies to be impossible for us to understand. Other lawyers even have a difficult time decoding the language in an insurance contract. This works to the advantage of the automobile insurance companies because they get the benefit of interpreting their insurance agreement several different ways, depending on the nature of the specific claim. This, of course, does not work out to your benefit.

Negotiating with an insurance claims adjuster for compensation after a car accident in Fort Smith or Little Rock Arkansas is often a time consuming and fruitless endeavor. Think about it. Claims adjusters are not threatened with anything if you don't have a car accident lawyer on your case. Without representation, there is no threat of a lawsuit, an excess verdict, or compelling case for them paying more money on your claim. So the car insurance adjuster is going to play the usual games with you. Requesting that you provide a recorded statement, sign authorizations permitting the claims adjuster to obtain all of your medical records, signing overbroad and unfair settlement release documents, and not getting the right medical treatment. Adjusters will tell you that your medical treatment was excessive and therefore they are not going to compensate you for this "unrelated" or "excessive" medical treatment.
Don't be a victim of these insurance games!

So what are you entitled to for compensation or for a personal injury claim settlement after a motor vehicle crash? First, you are entitled to the economic losses. These are the losses that have the dollar signs in front of a specific expense brought about by the collision. Examples are your past and future medical expenses, lost wages, prescription medication costs, co-pays, deductibles, fuel expense for trips to your doctors, and other direct financial harms caused by the other person's negligence.

You are also entitled to compensation for non-economic, or "general" damages. These are the harms that do not have the dollar signs. Examples include
	pain and suffering,
	emotional trauma,
	loss of quality of life,
	marital strain,
loss of mobility, etc. These damages can be particularly difficult for a jury to put a number on. With the help of an experienced
Fort Smith car accident lawyer, your attorney will explain these general damages in terms that we call can understand. After all, medical records are typically bland and don't paint the full story of how you have been negatively affected.

Contact an Arkansas injury attorney as soon as possible after an accident, even if it is just to obtain a free consultation to determine what your legal options are. Consultations at the
Arkansas Injury Law Center are free of charge and will answer all of your questions about the injury insurance claims process.

Supreme Court Rules Cap on Punitive Damages in Arkansas Unconstitutional

In a landmark case last week the Arkansas Supreme Court took a second look at a $50 million dollar verdict assessed against Bayer CropScience. The premise of the case dealt with contamination of the food supply by genetically altered seeds. A Lonoke County jury awarded $42 million in punitive damages against Bayer in April 2010. The lower court attempted to limit the punitive damages amount assessed in that it would shock the business culture in Arkansas and have a "chilling effect" on capitalism in the state. The plaintiff's in this case, along with must other Arkansas accident injury attorneys disagree.

In a clear decision by the Arkansas Supreme Court, the cap on punitive damages was ruled unconstitutional, a decision that the lower court had reached in the case. The Chamber of Commerce chimed in on the decison as something that would have a horrible effect on businesses in the state. Why is that? Because large companies will be held legally accountable by our civil justice system? We think Scott Powell, an Alabama lawyer who reperesented the injured plaintiffs in this case said it best in that this decision by the court will help deter bad conduct of big business.

The civil justice system is in place as a mechanism of checks and balances for the conduct of corporations. If a company markets, sells, and profits from a product, it must be held fully accoutable to anyone that it injures along the way. If that isn't the case, citizens are in imminent danger because there will be nothing to stop reckless conduct of big business. And lets remember, this isn't some arbitrary court system. Each case is ruled on by a group of jurors, representing the community and the state of Arkansas. These are individuals who are not beholden to anyone or any company. The civil justice system is a beautiful thing. Placing caps on what the jury can, or cannot award, is an unfair limit on our constitutional rights, as citizens, to seek redress from the courts.

Our Little Rock injury lawyers will continue to fight for justice in each case where a client is injured due to the careless or reckless conduct of another person or business. What we do each day in Arkansas courts is an effort to deter future negligence and create a safer state for our children. If you want to discuss your situation with one of our

Being involved in an accident can change your life. Your livelihood can be turned upside down, financially, physically, and emotionally, It is not uncommon for an accident to cause fractures, whiplash, or even
brain damage. These injuries can require medical care that costs thousands of dollars. You may become unable to go back to work immediately and as a result, you lose out on income. The sitaution is compounded if you are supporting a family. Where do you look for advice? The internet has certain legal resources for people involved in crashes, but it isn't always accurate. Contacting an
Arkansas accident injury lawyer may be the smartest move, right from the start.

Who is going to pay for my medical bills? If you have health insurance, then your bills should be covered. Do NOT let your medical bills be submitted to the at-fault party's car insurance. When this happens, you are short-changed money; compensation that is due to you in accordance with Arkansas law.

What types of settlement can I expect? That is a very difficult question to answer, especially before you have obtained complete medical care for your injuries. After all, you don't want to begin negotiations until you know what damages you are negotaiting for. This is something we preach heavily to our clients. Any lawyer that tells you what your case is with on the first meeting is either not an expert in injury law or is lying.

How can I get medical treatment if I don't have health insurance? Our injury attorneys have contacts with local physicians in Little Rock, Jonesboro, Bentonville, and other cities in Arkansas. These physicians may be willing to provide you with competent medical treatment and not charge you until your injury claim is resolved by the Arkansas Injury Law Center. After all, the number one most important thing is your good medical care.

How long does this whole process take? The lawyers in our office work aggressively to pursue the at-fault parties and obtain maximum compensation from all avenues of recovery. Equally important, we seek a settlement that covers all aspects of our client's damages, including lost wages, pain and suffering, and any potential future surgical costs. The length of the process varies from case to case, but generally you case can be resolved within a few months. However, some of our serious injury or death cases can last years.

An Arkansas car accident lawyer at our Injury Law Center will meet with you to discuss every aspect of your case. You will meet with an actual attorney, not a paralegal or "case screener." This process ensures that each client is provided personal experience from the very start of each case.

What is at stake in an Arkansas semi-truck accident?

Arkansas has a significant amount of semi-truck traffic. Several interstate highways that connect north, south, east, and west run through the state. Due to this increasing amount of tractor-trailer traffic, major collisions are a regular occurence. Most recently, a federal jury in northern Arkansas found a trucking company liable to pay $7 Million to a Missouri truck driver who was fatally injured when his truck impacted another tractor-trailer. The collision involved Roger Reagan and another truck owned and operated by Dunaway Timber Company and driven by driver Morgan Quisenberry. The allegations reflect that Quisenberry was apparently fatigued and drifted over the centerline of traffic and crashed nearly head-on into Reagan, who was a family man from Farmington Missouri.

Fatigued trucking driving is the most dangerous safety concern throughout the trucking and casualty insurance industry. Truckers regularly operate their rigs for more consecutive hours of road time than is allowed by the Federal Motor Carrier Safety Regulations. This presents a serious safety hazerd for both passenger cars and other truckers on Arkansas roads and highways. It is such commonplace that many truckers joke about having two sets of driver logbooks. One set are the "fake ones' that truckers will show to police and authorities when they enter scales or are stopped by law enforcement for roadside safety inspections. Then there is a second set of logbooks which contain the "real hours" worked by that driver for a certain 24 hour time period. We are not making this up. Go to a truck stop and ask a truck driver and if he or she is honest, you will hear about the two sets of logbooks.

As an Arkansas semi-truck accident lawyer, I can tell you that our law firm has investigated and prosecuted countless cases where a fatigued truck driver caused, or contributed to cause, a serious and/or fatal truck crash. The cirumstances are almost always the same and share a common set of facts...a trucking company is pressuring its driver to haul as much frieght as possible in a given time period, causing that driver to operate in excess of the time limitations set forth for truck driving by the federal government and Arkansas state law. The driver may not be "tired" by is overly "fatigued", which are two completely different things. The fatigued trucker lets his guard down and next thing you know, a major collision happens. These are almost always "preventable" collisions. There is no such thing as a "fatigued accident." These are
conscious decisions made by truckers and the trucking companies they haul freight for.

At the Arkansas Injury Law Center, our attorneys investigate semi-truck crashes in Little Rock, Rogers, Fayettevill and everywhere in between in the state of Arkansas. Our
experienced injury lawyers aggressively pursue justice on behalf of innocent victims of these preventable truck crashes. This all starts with an initial client lawyer consultation, which is both free and confidential. Terms of representation are discussed as well as the precise steps to take in an tractor-trailer accident claim for compensation. To learn more about this complex process, contact one of the

Driver of Motorcycle Killed After Rear-end Collision in Green Forest Arkansas

Our Arkansas death lawyers are following news of a fatal collision that took place early Saturday evening near Green Forest. The collision claimed the life of a motorcyclist, Justin Maybee, who was just 32 years old at the time of the crash. Maybee sustained fatal injuries when his 1996 Yahama motorcycle was rear-ended by a Chrysler Sebring being driven by 47 year-old James McNich of Alpena Arkansas. His vehicle struck the motorcycle so hard that both Maybee and his passenger, 20 year-old Crystal Simmons, were ejected from the bike and thrown over 50 feet from the impact. Both Maybee and Simmons were airlifted to St. Johns Hospital in Springfield, Missouri. Simmons sustained critical injuries for which required level-1 trauma care. Niether riders were wearing helmets, although that is not illegal pursaunt to Arkansas traffic laws.

This crash, which took place on US Highway 62, is an all too common occurence when motorcycles are rear-ended by passenger vehicles. Drivers of cars often argue that motorcycles are hard to see, especially at night. However, this is not an excuse for any collision. Drivers of cars have a duty, imposed by law, to exercise care when driving and operating their vehicles. And the bottom line is this: You must keep a careful lookout when you are driving, so not to endanger other drivers, including motorcyclists. When a driver does not keep a proper lookout and causes a collision, he or she may face criminal and civil penalties. In a case such as this, where the weather was clear, dry, and not a factor, police and motorcycle injury lawyers will be looking to the driver of the car as a potential cause of the collision.

Car accidents involving motorcycles can prove to be fatal more often than not, especially when the impact is from the back. Riders are often ejected and factures and head trauma are common. A traumatic brain injury (TBI) can result and lead to a lifetime of medical treatment and "special damages" which can include lost wages and loss of earning capacity. An
Arkansas motorcycle accident attorney can assist in these types of situations.

The Arkansas Injury Law Center is a group of accident injury lawyers and specialists dedicated to helping accident victims and families suffering from a fatal crash navigate the legal system. They do this because it spells a reduction in corporate profits. After all, insurance companies are in existence to make a profit. Don't become another person taken advantage of by the insurance gameplay. Contact an

Helpful Advice from an Arkansas Personal Injury Lawyer

The Arkansas Injury Law Center receives many phone calls each day, most of which are from residents injured in car accidents in big cities such as Little Rock, Bentonville, Fort Smith, Fayetteville, and Springdale. Sometimes callers have just been involved in the auto crash, others have been fighting with an insurance adjuster for several months and are just fed up. Either way, we are often asked for advice on how to handle a car accident insurance claim for bodily injury. Commonly referred to as a "PI Claim", insurance adjusters will do everything under the sun, including using unethical negotiation tactics, to force you into accepting a low ball settlement.

There a few things you can do from the start to protect yourself and your legal interests. This by no means is a substitute for clear and concise advice from one of a Arkansas car accident lawyer. First, always call police at the scene and request that a comprehensive accident report be completed by the reporting officers. Second, seek medical attention immediately at the nearest emergency room. If your injuries are life-threatening, you will likely be ambulated to a Level-1 trauma center in closest proximity to the crash scene. On ocassion, first responders will dispatch a life-flight helicopter for quickest transport to a local hospital. Third, contact an
accident injury lawyer to obtain free advice on how to best manage your claim. Speaking with an insurance claims adjuster first is never a good idea. These claims adjusters will demand recorded statements and other requests that are overbroad.

Seeking follow up medical treatment for your injuries may also be required. From fractures to soft-tissue injuries, it is usually medically sound for you to seek advice on the extent of the injury and whether or not there are any future medical concerns that may at issue. Examples of future medical concerns may include artritus or even future surgery. People with whiplash and other spine injuries from an auto accident will commonly complain of pain and loss of range of motion for years to come. That condition can give rise to a disc fusion, disc replacement, or other major surgery.

Personal injury claims from a car accident can involve complex areas of law and medicine. It is always risky to face an insurance claims adjuster and large insurance company without legal representation, for more reasons that could possibly be addressed in this article. The important thing to understand is that initial consultations with a personal injury lawyer are usually free of charge. It certainly doesn't hurt to discuss your case, get informed, and make an educated decision on whether your case requires the legal representation of an

Fatal Car Accident Near Little Rock Calls for More Attention Behind the Wheel

Rear-end car accidents in Arkansas are usually caused by one of three factors: following too closely, inattention, or traveling too fast for road conditions. Commonly referred to as the Arkansas Rules of the Road, there are laws and statutes that require each driver in Arkansas to exercise the highest degree of care. This means paying attention to what is ahead and following all posted speed limits. In addition, we learn safe following distances when we take our drivers test. Arkansas law states that when you rear-end someone in a car accident, that there is a presumption of negligence.

Following too close is presumed to have resulted in a fatal car accident near Little Rock, according to authorities. The crash that occurred near the intersection of Cantrell Road and Rservoir Road claimed the life of 37 year-old Timothy Woodbury. Woodburg was stopped in traffic in his Mazda Protege when the driver of a Nissan Altima rear-ended him at a high rate of speed. The impact caused Woodbury's vehicle to veer into oncoming traffic, where he was again struck, this time by a large Ford pickup truck that was hauling a trailer.

The Arkansas Injury Law Center handles fatal car accident claims by conducting a comprehensive independent investgiation into the causes of the crash itself.

The Arkansas Injury Law Center is both proud and excited to announce the launch of a completely redesigned website for our clients. The new design was a product of imput from our clients and focus group research on what people want to learn about when researching lawyers and law firms on the Internet. Our
Arkansas personal injury lawyers are dedicated to providing the best legal representation possible for folks injured throughout the state. This is the number one mission of our law firm. Our injury attorneys not only provide top notch legal assistance, but a close attorney/client relationship that lasts during, and after a case. Clients are provided the cell number of each lawyer working on the case. This is very unique in the legal industry and something we implemented from day one.

The Arkansas Injury Law Center is physically located at 609 SW 8th Street, Suite 600, Bentonville, Arkansas, 72712. However, the experienced lawyers in our organization service all of Arkansas, including Little Rock, Fort Smith, Fayeteville, Jonesboro, Benton, Pine Bluff, Hot Springs, Conway, and Rogers. An attorney will commonly travel to the home of our client to meet with them in an environment they feel most confortable. After all, our law firm was organized around a philosophy of ultimate client service.

As an Arkansas car accident lawyer, I hear a common concern from clients that contact me each day. They are looking for an attorney who will be accessible, responsive, and aggressive. The Arkansas Injury Law Center provides this level of service to each client. From clients with brain injuries to surviving family members who file an
Arkansas wrongful death lawsuit, each client is provided updates on cases through any preferred medium of communication. For many clients, that is email. Others want weekly phone calls. So why does our law firm put our client's FIRST? Its simple. Founding partner Stephen Schultz was seriously injured in an auto accident and learned, first hand, what it is like to be at home, vulnerable, and not knowing who to turn to or trust. This experience led Stephen to enroll in one of the top law schools in the country and dedicate his carrer to helping people who are going through what he went through in his youth.

If you are looking for top legal help from an Arkansas personal injury attorney, we encourage you to surf our informative website and call us with any questions. All case consultations are free and carry no obligation whatsoever. Stay safe Arkansas!
