Driver of Motorcycle Killed After Rear-end Collision in Green Forest Arkansas

Our Arkansas death lawyers are following news of a fatal collision that took place early Saturday evening near Green Forest. The collision claimed the life of a motorcyclist, Justin Maybee, who was just 32 years old at the time of the crash. Maybee sustained fatal injuries when his 1996 Yahama motorcycle was rear-ended by a Chrysler Sebring being driven by 47 year-old James McNich of Alpena Arkansas. His vehicle struck the motorcycle so hard that both Maybee and his passenger, 20 year-old Crystal Simmons, were ejected from the bike and thrown over 50 feet from the impact. Both Maybee and Simmons were airlifted to St. Johns Hospital in Springfield, Missouri. Simmons sustained critical injuries for which required level-1 trauma care. Niether riders were wearing helmets, although that is not illegal pursaunt to Arkansas traffic laws.

This crash, which took place on US Highway 62, is an all too common occurence when motorcycles are rear-ended by passenger vehicles. Drivers of cars often argue that motorcycles are hard to see, especially at night. However, this is not an excuse for any collision. Drivers of cars have a duty, imposed by law, to exercise care when driving and operating their vehicles. And the bottom line is this: You must keep a careful lookout when you are driving, so not to endanger other drivers, including motorcyclists. When a driver does not keep a proper lookout and causes a collision, he or she may face criminal and civil penalties. In a case such as this, where the weather was clear, dry, and not a factor, police and motorcycle injury lawyers will be looking to the driver of the car as a potential cause of the collision.

Car accidents involving motorcycles can prove to be fatal more often than not, especially when the impact is from the back. Riders are often ejected and factures and head trauma are common. A traumatic brain injury (TBI) can result and lead to a lifetime of medical treatment and "special damages" which can include lost wages and loss of earning capacity. An Arkansas motorcycle accident attorney can assist in these types of situations.
